(1) The purpose of this Policy is to: (2) The University is considered a Declared Organisation under the Road Transport (General) Regulation 2013 and subsequently has the authority to regulate the entry, operation and parking of vehicles on University Land. (3) Where the University’s operations are in areas outside those specified under the Declared Organisation authority, the Vice-President Operations may direct the Executive Director, Infrastructure and Property Division to implement other control and enforcement measures to manage or restrict parking access. (4) A Driver operating a vehicle or bicycle on University Land, or anyone who enters University Land with a vehicle or bicycle, is required to comply with this Policy. (5) This Policy should be read in conjunction with: (6) Subject to compliance with the provisions of the Campus Access and Order Rules and this Policy, pedestrians, bicycles and vehicles may have access to University Land for legitimate University-related activities and recreational activities. (7) Parking on University Land is restricted and parking conditions, as prescribed in this Policy, will be applied appropriately to ensure effective parking and traffic management. All University land across locations, falls within the scope of this Policy, including Student Accommodation Residences and other facilities, such as the Graduate School of Medicine Accommodation (Bowral). (8) University Land is private property. Internal roads, carparks and access roads are defined as roads or road related areas within restricted parking areas. (9) Non-compliance with the provisions of this Policy, may result in penalties being applied. (10) The University reserves the right through the Authorised Person to withdraw and/or cancel permission to park on the basis of this Policy. (11) Drivers who access, travel on and/or park a vehicle on University Land do so at their own risk and are responsible for their vehicle and any valuables left unattended in their vehicles. (12) Entrants who bring a vehicle onto University Land, acknowledge that they are the owner, or an agent of the owner, for that vehicle and that they are aware of, and bound by this Policy. (13) Whilst the University takes all due care, drivers are responsible and liable for any injury, damage, theft or loss (including consequential loss) to any person or vehicle while travelling, standing or parked on University Land, no matter how it is caused, contributed to, or sustained, including by the fault and neglect or negligence of the University. (14) Heavy vehicles (i.e. greater than 4.5 tonnes) requiring access on paved or pedestrian areas must receive prior approval from an Authorised Person. (15) If a bollard is removed for access, it must be immediately replaced to restrict access of other vehicles. (16) As a condition of entry to University Land, all Drivers indemnify (that is, secure and compensate against loss) the University (including its officers and employees) from all claims, actions or demands brought by, for, or on behalf of the Driver or any third party for injury, damage or loss sustained to the Driver or the Driver's Vehicle caused by the fault or negligence of the Driver in the use or operation of parking a Vehicle or Bicycle on University Land. (17) To the extent that any liability arises under the Australian Consumer Law or the Competition and Consumer Act, 2010 (Cth), then the University’s liability is limited to the maximum extent permitted to the resupplying of the relevant goods and services. (18) Drivers must remove the vehicle from University Land if requested to do so by an Authorised Person. (19) At all times on University Land pedestrians have right of way and must act in accordance with the Road Rules 2014. Cyclists and pedestrians are responsible for themselves, and must be aware of vehicles and follow the directions of Authorised Persons. (20) The Road Rules 2014 and the Road Transport (General) Regulation 2013 apply at all times. The Driver may be fined or penalised under those Rules. (21) Drivers operating, or in control of a vehicle or bicycle shall at all times: (22) Bicycles are permitted to be ridden within carparks, on roads and suitable paths. Bicycles must be ridden in a safe manner and in accordance with the Road Rules 2014. (23) Electrically power-assisted bicycles may only be used on University Land in accordance with the Road Rules 2014. (24) University Carparks are signposted, where approved, as Restricted Parking Areas under the Road Transport (General) Regulation 2013. (25) Parking restrictions apply as signposted. (26) The use of all carparks remains at the absolute discretion of the University. (27) The erection of parking signs on University Land must be approved by the Infrastructure and Property Division in accordance with the NSW Roads and Maritime Services Guidelines. Fines cannot be issued for failure to observe any signs not approved by the Infrastructure and Property Division. (28) All University carparks are monitored and parking conditions may be enforced by Authorised Persons. (29) The vehicle number plate must be detectable via electronic scan or by physical sighting by an Authorised Person. (30) Parking conditions vary, depending on the area of University Land and within designated carparks. Hours of parking operations are stated on signage and the University parking website (www.uow.info/parking). (31) Parking is limited on University Land. With the exception of Reserved Parking, where a designated space is allocated, there is no guarantee that a parking space will be available, even if the driver holds a valid Permit, has an active CellOPark session, has been issued a QR code, or holds a valid ticket. (32) Any Vehicle parked in a University Carpark must have paid for parking where required to do so, as stated on signage. (33) Access to parking on University Land, where signposted as such, is via the purchase or acquisition of a Permit or Casual Parking. There is limited non-fee access to parking for designated categories. (34) The Authorised person has discretion to: (35) The provision of parking bays and allowed areas varies across University Land in accordance with available space and operational requirements. Designated areas and the parking restrictions within each carpark is outlined on the University Parking Website. (36) Drivers must ensure that their vehicle is not standing, waiting or parked for a period that exceeds the time shown on approved signage, or contrary with this Policy. (37) Unless authorised to do so by an Authorised Person, all Vehicles must be parked within the lines designating a parking space and must not, at any time: (38) At all times vehicles must be parked in accordance with this Policy. (39) Bicycles may only be parked in areas where the University has provided appropriate bicycle stands or within a Bike Base. (40) Bicycles must not be attached to trees, railings, light posts or stored inside buildings except within a University provided Bike Base. (41) Drivers are responsible for payment of the relevant parking fee for the carpark they are parked within. (42) Conditions for the payment of fees are outlined on the University Parking Website. (43) Parking fees and charges may be adjusted and approved by the Authorised Person. (44) All fees and charges paid under this Policy are non-refundable. (45) Permits are issued for access to parking on University Land to eligible drivers. Eligibility, areas of use and conditions of parking are outlined on the University Parking website. (46) Drivers can apply for a permit through the vPermit portal, and must meet requirements detailed on the University Parking Website. (47) Where payment is required, the driver or vehicle owner must pay the prescribed fee. (48) It is the responsibility of the permit holder to ensure all details, including vehicle registration details are current for the Vehicle parked on University Land. (49) Only one vehicle may use an allocated permit on University Land at any one time. (50) It is the responsibility of the vehicle owner to change or update the active vehicle status on the vpermit application. (51) Failure to change the ‘active vehicle’ status in vPermit, is not a valid reason to seek to rescind any fines issued to a vehicle. (52) Permits cannot be resold, transferred to another person, or purchased on behalf of another person. (53) Anyone with a legitimate reason for parking on University Land may access casual parking areas, provided they have parked their vehicle in accordance with this Policy, the conditions outlined on the University Parking Website, signposted conditions, and have paid the prescribed fee. (54) Pay and Display tickets and CellOPark sessions are only valid in designated casual parking areas as signposted and outlined on the University Parking Website. (55) Where a driver is accessing parking in a parking station, they must pay the required fee and abide by the conditions as outlined on the University Parking Website. (56) If a visitor has been issued a QR code via a business area or tenant, they may only use this in the area advised at the time of issue. The business area must notify the visitor where they are authorised to park. (57) Certain University vehicles are exempt from having a permit or having paid parking, provided the vehicle is clearly identified and badged. (58) Certain vehicles belonging to Authorised Contractors and public utility service vehicles are exempt from having a permit or having paid parking, provided they are clearly identifiable with the organisation’s logo, and are one of the Authorised Contractors outlined on the University Parking Website. (59) Where a vehicle is not classified as exempt, or is exempt, but is not clearly identifiable with the organisation’s logo, the driver must pay for parking in accordance with this Policy. (60) Vehicles displaying a valid mobility parking permit may park in designated areas on University Land without charge. (61) Under this Policy, a current mobility parking permit must be displayed. (62) Charging of electric vehicles is permitted in designated electric vehicle charging areas, for the duration and conditions as outlined on signage and on the University Parking Website. (63) In designated publicly available electric vehicle charging areas, parking is only permitted in the bay while the vehicle is actively charging. Once charging is complete, the vehicle must be moved from the electric vehicle charging bay. (64) Fines may be issued to those who park in the designated bays when not charging their vehicle, and for those who park a non-electric vehicle in a bay designated for electric vehicles. (65) Vehicles breaching the traffic provisions in this Policy may be stopped by an Authorised Person. Drivers may be reported for non-compliance with the Campus Access and Order Rules or, where appropriate, reported by an Authorised Person to the nearest police officer. (66) Mobile licence plate recognition is used by the University to validate vehicles parked in a University carpark or car parking area to ensure vehicles meet paid parking requirements. (67) Vehicles that are not parked in accordance with signage, the Road Transport (General) Regulation 2013, or the Road Rules 2014 may be issued a fine processed by Revenue NSW on behalf of the University. (68) Fine amounts are set by the State of New South Wales. The University has a Memorandum of Understanding (MOU) with the NSW Commissioner of Fines through Revenue NSW for the processing of fines. (69) A fine will be issued in accordance with the Self-Enforcement Infringement Notice Scheme (SEINS) requirements, as outlined by Revenue NSW. (70) Any person may request a review of a fine by Revenue NSW. Advice on the ‘request for review’ process is available on the fine or via the Service NSW website. (71) Where a ‘request for review’ is received, Revenue NSW may contact the University to provide information relating to the fine. (72) Persistent or blatant violation of this Policy may result in a Permit being revoked, and/or vehicular access to the University denied by an Authorised Person. (73) Bicycles which are not parked in a designated bicycle rack or Bike Base provided by the University or appear to have been abandoned (4 weeks without use), may be impounded and disposed of by Authorised Persons in accordance with local operating procedures. (74) Requests for review and appeals of parking fines should be directed to Revenue NSW. Term
Definition
Approved Contractor
An authorised business providing services to the University and may include any contractor contracted to service or maintain building plant, equipment or services, including office or lab equipment. It also includes Authorised Persons employed by a business providing services or goods to the University.
It does not include persons who may be contracted or employed under a workplace agreement or other contract to undertake academic, general staff, technical or professional related duties.
Authorised Person
As defined in the Campus Access and Order Rules.
Bicycle
As defined in the Road Rules 2014.
Bike Base
A storage facility designed for parking bicycles on University Land.
Carpark
Means car parking areas on University Land that are provided and operated by the University.
Casual Parking
Unreserved parking space set aside for use by Entrants for the parking of motor vehicles.
Casual Parking payment types include:
Controlled Entity
Those entities over which UOW has control, as defined in section 16A of the University of Wollongong Act 1989 (as amended) and section 2.2(1) of the Government Sector Finance Act 2018.
Declared Organisation
An organisation that has been declared the parking authority for an area of operations in Schedule 2 of the Road Transport (General) Regulation 2013.The University is a Declared Organisation under this Regulation.
Driver
The owner or operator of a motor vehicle or bicycle brought, operated or parked on University Land.
Electric Vehicle
A vehicle solely powered by electricity, that does not have a petrol, diesel or LPG engine, fuel tank or exhaust pipe. Also referred to as a Battery electric vehicle (BEV) or ‘plug in’ vehicle.
Enforcement Officer
A person employed by a parking authority as an Enforcement Officer as specified in Schedule 4 of the Road Transport (General) Regulation 2013. UOW Security Officers meet the requirements of Class 15 persons in accordance with the Regulation.
Entrant
Any person who enters upon University Land, regardless of their status as Student, Staff, Affiliate, alumni, or member of the public.
Legitimate Reason
Use of University Land and/or Public Space for the purposes of UOW’s core functions, including education, teaching, research, and accessing community services, or as otherwise approved in writing by the University under the relevant policy or procedure.
Mobility Parking Permit
The Mobility Parking Scheme (MPS) provides parking concessions to people with mobility disability.
There are two types of permits issued by Transport for NSW (TfNSW):
individual (blue card) – issued for 5 years if you have a permanent disability
temporary (red card) – issued for up to 6 months if you have a temporary disability.
An Australian Disability Parking permit (large purple card) is also issued by TfNSW and must be displayed with your MPS permit to be eligible for parking concessions.
Mobility Parking Permits may be issued by NSW Roads and Maritime Services or an authority of another Australian State or Territory. Foreign country mobility parking permits recognised for the purpose of disability parking concessions under NSW laws and regulations will also be accepted.
NSW Road Transport Legislation
Relevant legislation for the State of NSW which is applicable to UOW’s campuses, including, but not limited to the following:
Permit
A virtual parking permit that authorises the holder to park in designated areas of University Land.
QR Code
Issued by the University to a business area or tenant for the purposes of providing parking to their visitors. The QR code requires the visitor to enter their own vehicle registration details with parking paid via the business area or tenant.
Public Utility Service Vehicle
As defined in the Road Rules 2014, a vehicle being used by a public authority, statutory body or an authorised distributor under the Electricity Network Assets (Authorised Transactions) Act 2015 in connection with the supply of water, gas, electricity. Also includes Vehicles utilised to remove waste and recycling.
Restricted Parking Area
The Road Transport (General) Amendment (Parking at University of Wollongong) Regulation 2015 under NSW Government Gazette no. 49 (6 February 2015) prescribes the University’s parking operations areas.
All University Restricted Parking Areas are sign posted at each vehicular entrance. The signage denotes when a Driver is entering or exiting a Restricted Parking Area. It is the Driver’s responsibility to ensure they are always compliant with signposted conditions.
Road Related Areas
As defined in section 13 of the Road Rules 2014.
SEINS
The Self-Enforcement Infringement Notices Scheme, administered by Revenue NSW.
Student Residence
Includes all residences managed by Student and Accommodation Services Division. Parking at Student Accommodation Residences is managed by Student Services Division.
University
Means the University of Wollongong and all Controlled Entities as defined in the Campus Access & Order Rules.
University Land
Includes any campus, land, building or road in Australia which, for the time being, the University of Wollongong (UOW) and/or its Controlled Entities (as applicable) owns or has a right of entry or occupancy (including by way of lease or licence) together with any building or structure or space, whether in whole or part, which is occupied or used in connection with UOW activities in Australia.
University Parking Website
Refers to www.uow.info/parking.
Vehicle(s)
All motor vehicles including motorcycles, as described in the Road Rules 2014, but excluding motorised wheelchairs.
vPermit Portal
The approved system for vPermit applications at www.vpermit.com.au/uow.
